KIRKBY ON BAIN PARISH COUNCIL
Minutes of the meeting held on Thursday 4th July 2024 in the school hall at 7:00 pm 
Present: With Councillor Briscombe in the Chair there were also present councillor(s) Thomas, Armitage, Obermuller, Russell, Cole and District Councillor Thomas Kemp. 

Absent: Councillor S. Midgley, County Councillor Patricia Bradwell and District councillor C. Leyland. 

Public: There was 10 members of public present.  

EA to discuss breech at start of the meeting – Apologies received unable to attend the council meeting. 

Public forum: 
A member of public raised concerns with Mill House manufacturing which have been working until 12:45am and the noise levels have increased. Another member of public told the council that the noise levels have increased considerably since the planning application went in. Cllr Thomas Kemp told all that ELDC have conducted tests on the noise and have found no nuisance, but he will take these comments back to the planning/ enforcement department for their attention. A member of public told him that the sites operating hours on their latest application is until 6pm but they are in operation well after this so it is a clear breach. The clerk was asked to write to planning enforcement about the excessive noise and breech of working hours.

2. Apologies for absence and reasons given 

Apologies received from Councillor Midgley, District councillor Leyland and county councillor  Bradwell. 
It was:-
Proposed by Councillor Obermuller and Seconded by Councillor Armitage and RESOLVED to accept the apologies.

3. To receive declarations of interest in accordance with the Localism Act 2011.  

     None. 

4. Notes of the council meeting held on Thursday 2nd May 2024 to be approved as minutes and signed by the Chairman.  

It was:-
Proposed by Councillor Obermuller and Seconded by Councillor Cole and RESOLVED by all that the notes be approved as minutes and signed by the Chairman. 

5. To receive reports from outside bodies
a) County Councillor – Nothing to report. 
b) District Councillor – See public forum, Councillor Kemp told the council, ELDC will continue to work with enforcement to get some results for the land at Reddings wood. 

6. Future of Kirkby On Bain Church hall 

Councillor Briscombe reported that he as the chairman to the parish council had been invited to a meeting to discuss the future of the hall. The PCC are the owners of the site and have discussed splitting the site in two 3 and selling one of those section to pay to fund the renovations needed on the hall. The PCC have asked the parish council to apply for a feasibility study to be carried out which will save them the cost of applying as this is something the parish council can get for free. The council agreed to do this but to only submit their application nothing else. 

7. Highways issues
a) Community Speed Watch – The clerk was asked to order a new sign so the CSW group can do the traffic in both directions. Cllr Armitage reported that the group has been out and they can train people to use the equipment they just need to get more volunteers. 
b) LGV control in KOB - Weight limit ,20 mph limit, pedestrian crossing. The clerk was asked to email Cllr Bradwell for an update on this and the feedback from the personal committee as well as getting the directional signs for the tip removed. 
c) Gritting bins – The clerk was asked to get some quotes for breaking apart the grit in the grit bins as it is solid. 

8. To discuss any Planning applications 
a) Mill House manufacturing – No statutory nuisance found, application submitted 
b) EC/094/00401/23 - Kirkby Lane adjacent to Reddings Wood see item 5b.

9. Finances:
a) Bank Balance and signing of Statements – The clerk was asked to send this via email as no new statement has been received. 
b) Payments required: - 
i. A. Jackson - £295.00
ii. S. Kulwicki – Wages for June and July - £411.32
iii. HMRC - £88.80
It was:-
Proposed by Councillor Obermuller and Seconded by Councillor Cole and RESOLVED by all that the above payments be approved and duly paid.  

10. Clerks’ correspondence

     None. 
     
11. The next meeting is scheduled for: Thursday 5th September at 7pm in Kirkby On Bain school hall. Are there any items for inclusion on the next agenda 

None.
