KIRKBY ON BAIN PARISH COUNCIL
Minutes of the meeting held on Thursday 7th March 2024 in the school hall at 7:00 pm
Present: With Councillor Briscombe in the Chair there were also present councillor(s) Thomas, Armitage, Obermuller, District Councillor Craig Leyland, District Councillor Thomas Kemp and County Councillor Patricia Bradwell.
Absent: Councillor J. Russell, S. Midgley and C. Cole and District councillor Kemp
Public: There was 5 members of public present.
Public forum:
No comments made by the public it was noted that the EA have started removing branches along the River Bain. Cllr Obermuller reported that the real tree pig wigs have very attractive social media attracting people to their site and they are selling local produce.

2. Apologies for absence and reasons given. - Received from Cllr Midgley and Russell.
It was:-
Proposed by Councillor Obermuller and Seconded by Councillor Armitage and RESOLVED to accept the apologies.
3. To receive declarations of interest in accordance with the Localism Act 2011. – Cllr Armitage raised an interest in planning item 7d as this is his property.
4. Notes of the council meeting held on Thursday 4th January 2024 to be approved as minutes and signed by the Chairman.

5. To receive reports from outside bodies
a) County Councillor Patricia Bradwell reported that she attended a flood meeting with the EA and IDB led by the local MP. She reported that the EA are going to work on the River Bain. They also have access to the devolution funding to help with this. She told the council that the re-surfacing on Tattershall Road should be done in 2024. Roughton Road and Main street will be done in 2026, she will try and get this moved forwards. The chairman reported that there is going to be a surfacing flooding meeting on the 11th March at his house to discuss the proposed works for KOB new drains. Cllr Bradwell asked is she could attend as well.
b) District Councillor Craig Leyland reported that the smallholding on Kirkby Lane is with enforcement and they are seeking legal advice, it will take time but it will be resolved. He reported that ELDC are waiting for an application for the extractors at Mill House manufacturing. They can only put a stop order on the business if its causing harm. The test carried out by the environment agency sound testing equipment is accurate and they stand by the original results. Cllr Leyland stressed that everyone has rights in any planning process. He also reported that a fund has been put together for the betterment of rural communities and 9 million pounds is available. There is a 12-18 month roll out for this and the funding officers will engage with local parishes to see what they want. Councillors to forward ideas to the clerk for projects in KOB that could be funded by this Rural Betterment scheme. District Councillor Thomas Kemp had no further comments.
c) Police – Not present, no report given.
6. Resilience/ emergency plan and flood recovery progress – Councillor Thomas is drafting a letter to the EA which he will circulate to the council for their approval. He has found some discrepancies in the EA’s recent report and would like to do some more investigations to ensure an accurate letter is sent.
7. To discuss any Planning applications
a) Mill House manufacturing – No statutory nuisance found, awaiting planning app. See 5b.
b) EC/094/00401/23 - Kirkby Lane adjacent to Reddings Wood. See 5b.
c) Ref: S/094/00132/24 - DEANS FARM, KIRKBY LANE, KIRKBY ON BAIN, LN10 6YZ - Planning Permission - Erection of a detached dwelling with detached car port, 3no. detached holiday lodges, excavation of land to form 2no. ponds and provision of associated access and car parking.

Proposed by Councillor Thomas and Seconded by Councillor Armitage and RESOLVED by all the council support the application but ask that a footpath be installed to Woodhall cemetery.
d) Ref: S/094/02490/23 - Planning Permission - Two storey extension to existing dwelling to provide additional living accommodation, part of existing dwelling to be demolished. POPLAR FARM, ROUGHTON ROAD, KIRKBY ON BAIN, WOODHALL SPA, LN10 6YL – Full planning has been given.
8. Highways
a) HGV’s and road weight limits – Cllr Bradwell will speak with highways about what can be done to get a weight limit in the village. Cllr Rusell has done some extensive research which the council appreciate and will investigate further if Cllr Bradwell is unable to make progress.
b) Community Speed watch – Cllr Armitage told the council that the group will be more active in the better weather. He is also arranging to go down and clean the reactive speed signs and solar panels. The chairman thanked him for his efforts.
9. Vehicle charging locations – The council had no response at this time.
10. Finances:
a) Bank Balance and signing of Statements. The clerk has not received a recent bank statement which she will chase and report back to council.
b) Payments required: -
i. LALC – Annual subs - £151.28
ii. S- Kulwicki wages for Jan and Feb and tax - £274.80

Proposed by Councillor Thomas and Seconded by Councillor Obermuller and RESOLVED by all that the above payments be approved.
11. Clerks’ correspondence – The clerk told the council that she has had a phone call from a local resident who has a large amount of sand bags outside his property and it keeps getting bigger. Cllr Bradwell agreed to investigate this.
12. The next meeting is scheduled for: Wednesday 1st May Annual parish meeting and 2nd May for the Annual council meeting both at 7pm in Kirkby On Bain school hall. Are there any items for inclusion on the next agenda. None

Proposed by Councillor Thomas and Seconded by Councillor Armitage and RESOLVED by all that the clerk be paid in line with NALC scale point 9 which equals £13.06 per hour.
