Minutes 02.05.2024

KIRKBY ON BAIN PARISH COUNCIL
Minutes of the meeting held on Thursday 2nd May 2024 in the school hall at 7:00 pm 
Present: With Councillor Briscombe in the Chair there were also present councillor(s) Armitage, Midgley, Russell, Obermuller and Cole. County Cllr P. Bradwell. 

There where 2 members of public present.

Public Forum: 
A MOP brought up their concerns with Milhouse manufacturing and the lack of interest in investigating the application from ELDC. The clerk informed them that a new application has been submitted but it is just waiting for the plans to be uploaded. 

1. Election of Chairman 

Cllr M. Obermuller Proposed Cllr M. Briscombe which was Seconded by Cllr S. Midgley RESOLVED. The chairman signed the declaration of acceptance of office. 

There were no other nominations. 

2. Election of Vice Chairman - signing of declaration of acceptance of office.

Cllr M. Briscombe Proposed Cllr B. Armitage which was Seconded by Cllr C. Cole RESOLVED. The Vice- chairman signed the declaration of acceptance of office.

There were no other nominations. 

3. Apologies for absence and reasons given – Apologies received from Cllr S. Thomas. No apologies from the District Cllrs. 

It was:-
Proposed by Councillor Obermuller and Seconded by Councillor Armitage and RESOLVED to accept the apologies. 

4. To receive declarations of interest in accordance with the Localism Act 2011 – None. 

5. Notes of the council meeting held on Thursday 7th March 2024 to be approved as minutes and signed by the Chairman.  

It was:-
Proposed by Councillor Obermuller and Seconded by Councillor Armitage and RESOLVED by all that the notes be approved as minutes and signed by the Chairman. 

6. To receive reports from outside bodies
a) County Councillor P. Bradwell told the council she is working on getting a weight limit restriction in place for KOB and Roughton. She told the council is has gone to scrutiny committee and she is waiting to hear from them. She told the council she had been doing investigations in to road costs and what funds are spent on. 
b) District Councillor not present, no repot given. 
c) Police not present, no repot given.

7. To discuss any Planning applications 
a) Mill House manufacturing – An application has been submitted awaiting the plans online, once they are active the council will be able to make comments. The main objection being the opening hours and the amount of on-site machinery  noise.  
b) EC/094/00401/23 - Kirkby Lane adjacent to Reddings Wood. No updates. 
c) Council have noted a large development which looks like an agricultural building being erected on Kirkby Moor, Brackenside Farm. The clerk was asked to investigate. 

8. Audit of accounts – presentation of accounts – Internal auditor has done checks all cleared for approval of this Council. 

a) To approve the annual governance statement in the annual return – The council read and understood to the best of their knowledge the annual governance statement.  

 It was:-
Proposed by Councillor Russell and Seconded by Councillor Midgley and RESOLVED by all that the annual governance statement be approved and signed by the chairman.  

b) To confirm and approve the Accounting statements contained in the Annual Return 

 It was:-
Proposed by Councillor Russell and Seconded by Councillor Midgley and RESOLVED by all that the accounting statements are correct and be signed by the chairman. 

c) To confirm the council as exempt from a limited assurance review 

 It was:-
Proposed by Councillor Russell and Seconded by Councillor Midgley and RESOLVED by all that the council sign the certificate of exemption to confirm the income and or expenses is less then £25,000.

9. Finances:
a) Bank Balance and signing of Statements 
b) Payments required: - 
i. Zurich insurance - £214.00
ii. Internal Audit - £45.00 
iii. S. Kulwicki – Wages for March and April - £268.20
iv. HMRC - £52.20
v. C. Cole APM refreshments - £12.79
It was:-
Proposed by Councillor Obermuller and Seconded by Councillor Armitage and RESOLVED by all that the above payments be approved and duly paid. 

10. Clerks’ correspondence
a) The clerk told the council that D-Day is imminently approaching and asked if they would like to do anything for the day. The council agreed to purchase a flag for the flag pole, up to £35.00. 
b) The clerk was asked to write a letter/email of complaint to the EA about the lack of attendance and no apologies at the annual parish meeting. 
c) Cllr S. Midgley told all that he has the filing cabinet with the council records at home which he would like removing. 

11. The next meeting is scheduled for: 4th July 2024 at 7pm in Kirkby On Bain school hall. Are there any items for inclusion on the next agenda…
a) Cllr Obermuller asked if the equipment at the public field/ school field can be replaced using grant funding. Cllr Briscombe will speak with the Brokenby? trust to see what can be done.
