Notes from 05.03.2026

KIRKBY ON BAIN PARISH COUNCIL
Minutes of the meeting held on Thursday  5th March 2026 in the school hall at 7:00 pm
 
Present: With Councillor Briscombe in the Chair there were also present Councillor(s) M. Obermuller, J. Russell, S. Midgley C. Cole and B. Armitage. District Councillor Craig Leyland and County Councillor Natlie Oliver were also present. 

Public: There was 8 members of public present.  

Public forum:
One member of public told the council that he was interested in the councillor vacancy he gave all present a run down of his skills and what he would be able to bring to the council can the community.  The clerk told the council one other member of public has also registered their interest in the vacancy. 

Another member of public told the council that he is still expressing concerns with the noise produced by Millhouse manufacturing. Another member of public agreed with him. 

Cllr Armitage told the council that he has raised a stage 1 and 2 complaint and the next step now is to go to the ombudsman. 

District Cllr Craig Leyland told all that ELDC has not been able to find a statutory nuisance and the complaint needs to go to the ombudsman now if the member of public wishes to take it further this would be there next step. 

Cllr Briscombe told all that there is now a vacancy on Kirkby on Bain PC and thanked the previous Councillor Savage for all their hard work and effort the have put into the community and what they continue to do via the flood resilience group. 

1. Chairmans remarks 

The chairman welcomed all present. 

2. Apologies for absence and reasons given.

None. 

3. To receive declarations of interest in accordance with the Localism Act 2011.  

None. 

4. Notes of the council meeting held on Thursday 8th January 2026 to be approved as minutes and signed by the Chairman.  

It was:-
Proposed by Cllr J. Rusell and Seconded by Cllr B. Armitage and RESOLVED by all for the chairman to sign the notes as minutes. 

5. To receive reports from outside bodies
a) County Councillor Natalie Oliver updated the council on the following:
i) The concerns raised with the curb on Wharf Lane (item 7a) has been actioned and it awaiting works to raise the curb and top up with gravel. 
ii) She told the council to speak with the previous Councillor to get an accurate update on the flood resilience meeting that has taken place. 
iii) The Bollards on Main Road, KOB have been re-installed on the grassed area. 
iv) The unsuitable for HGV signage for Kirkby Lane has been installed, pc to check this. 
v) The verge restoration should take place in April/May. 
vi) The weight restriction strategy is still ongoing. 

b) District Councillor Craig Leyland updated the council on:
i) Budget for ELDC has been set with an increase of 2.99%
ii) 10 million investment fund will be available to apply for
iii) Business development fund to help improve energy efficiency. 
iv) Local government reorganisation is imminent
 
6. Church Hall – Update 

Cllr Briscombe told the council that he the PCC has met with 3 builders to do the costings and has another 4 lined up so they can then accurately apply for the funding. 

7. Highways – Any issues to report 

a) Reoccurring surface water issue on Wharf Lane – see item 5,a,i. 

b) Parking on Main Street – email of concern received – Cllr Leyland told all that the turning space is beyond the control of the planning condition. 

c) Cllr Briscombe reported that fencing installed on Welsyke Lane has had to be moved back as it was encroaching on to the highways verge area. 

d) Cllr Rusell reported to Cllr Oliver a noisy drain cover outside Stella Maris. 

e) Cllr Armitage reported to Cllr Oliver a cluster of pot holes on Rhymes Lane between 40mph – 60mph signs. 

8. Community engagement 

Cllr Briscombe reported that the council has made some improvements by altering seating arrangements and offering the chance for an informal chat at the end of the council meeting. The councillors were happy with these current changes and no further suggestions were made. 

9. Flood resilience integrated scheme

No Updates. Cllr Armitage told all the there is an opportunity for a sign up event to be held by groundwater for their early warning system. He wanted to see if the council and member of public present would join up to this scheme. They confirmed that they would. 

10. Emergency Planning Group – Plan updates 

Cllr Armitage reported that he has completed the plan and is awaiting a response from community resilience. He has used Polar Barn as the emergency base. 
11. Playground equipment progress 

Cllr Obermuller reported that all the grant funding is now in place. He thanked all the members of public for putting their comments forwards when he and Cllr Rusell went door to door. If the weather is good the install will start on the 23rd March. He made it clear that this field is for use of the public and not just the school. A pedestrian gate will be installed by the trust and will not be locked. 

12. To discuss any Planning applications 

a) EC/094/00401/23 - Kirkby Lane illegal small holding progress. Planning for this has been finalised. It is not illegal to run a small holding, the issue is with them being believed to live on site but they do pay council tax elsewhere which leads ELDC to believe that they do not live on site. 

Animal welfare issues should be reported to DEFRA. 

13. Finances:
a) Bank Balance and signing of Statements – February - £39045.32

b) Payments required:
i. LALC (Lincolnshire association of local councils membership) - £164.38
ii. LALC (Annual training scheme) - £156.00
iii. S. Kulwicki – Wages for Jan and Feb - £366.00
iv. HMRC PAYE- £209.20
v. Bank Fees - Jan and Feb - £8.50 
c) Income:
i) The Brocklesby charity - £6500.00
ii) ELIF - £24,999.00

It was:-
Proposed by Cllrr M. Obermuller and Seconded by Cllr C. Cole and RESOLVED to approve the payments. 
     
14. Clerks’ report and correspondence

a) Insurance response and price for adding equipment – cost to add 4-6 items is £137.00. The council were happy with this cost. 
b) Local Government reorganisation consultation – comments to be sent to the clerk. 

15. Annual parish meeting – date scheduled for Sunday 24th May from 2-4pm at the field. It will be a village picnic. Toilet hire will be £150 plus VAT for 2 porter loos. 

16. The next meeting is scheduled for: 14th May 2025 at 7pm in Kirkby On Bain school hall. Are there any items for inclusion on the next agenda – None. 

The meeting closed at 8:06pm
