KIRKBY ON BAIN PARISH COUNCIL
Minutes of the meeting held on Thursday 8th January 2026 in the school hall at 7:00 pm
Present: With Councillor Briscombe in the Chair there were also present Councillor(s) M. Obermuller, J. Russell, M. Savage, C. Cole and B. Armitage. District Councillor Thomas Kemp and County Councillor Natlie Oliver were also present.
Public: There was 7 members of public present.
Public forum:
One member of public told all that he has never attended a council meeting and would like to see what is discussed on agenda item 12.
1. Chairmans remarks
The chairman welcomed all present and thanked them for coming. He also wished everyone a Happy New Year.
2. Apologies for absence and reasons given.
Apologies received from District Cllr Leyland.
3. To receive declarations of interest in accordance with the Localism Act 2011.
None.
4. Notes of the council meeting held on Thursday 6th November 2025 to be approved as minutes and signed by the Chairman.
It was:-
Proposed by Cllrr M. Obermuller and Seconded by Cllr C. Cole and RESOLVED by all that the notes be approved as minutes and signed by the Chairman.
5. To receive reports from outside bodies
a) County Councillor – Not preset.
b) District Councillor Thomas Kemp told all that the county councils budget is being setup at the moment and they are under lots of financial constraints. Cllr Obermuller asked if the District Cllr Grant is available Cllr Kemp tod him that he will keep him updated as it is all dependent on the budget setting.
6. Church Hall – Update
Cllr Briscombe reported that there have been no updates on this. The clerk will send over some local contractors contact info for costings.
7. Highways – Any issues to report
Cllr Armitage reported that the HGV route signs are multiplying which is great but one is still needed on Welsyke Lane. The council will continue to send in number plates and photos to the county councillor for action.
Cllr Briscombe did discuss gritting locally but no solution could be found.
8. Definitive Map Modification Order Application 610- Kirkby on Bain, Tumby, Tattershall Thorpe and Tattershall – Claimed Public Footpath - County Council is investigating an application for a Definitive Map Modification Order (DMMO) to amend the Definitive Map and Statement (the legal record of public rights of way) by adding a public footpath
It was:-
Proposed by Cllr Briscombe and Seconded Cllr Savage by and RESOLVED that the council has no evidence to submit.
9. Flood resilience integrated scheme
Cllr Savage reported that the drop in sessions was very well attended the EA did come as well, there was lots of agencies present which could answer everyone’s questions raised. A flood resilience group will be formed once the agencies have had a meeting to decide on what is appropriate for Kirkby On Bain.
Cllr Armitage circulated a report before Christmas, the ground water programme needs more people to sign up, but they need to hold a public meeting to do this. Cllr Savage suggested this be done in line with the resilience groups next meeting.
Cllr Cole reported that the pump for the pub has been purchased and on Saturday morning there will be a training session on how this works at the Ebrington Arms.
10. Emergency Planning Group – Plan updates
Cllr Armitage reported that he is working on this but an emergency base is needed. They have one confirmed outside of the area but they need one in the area, the school being the only building that meets these needs but he hasn’t been able to get a response from them. Cllr Savage will liaise with the school on this.
11. Playground equipment progress – Cllr Obermuller
Cllr Obermuller reported that the grants have all been awarded and there will be a site meeting with KOMPAN on the 20th January at 9am on the field, he welcomed all to come along.
12. To discuss any Planning applications
County Cllr Natlie Oliver arrived at 7:34pm
The clerk told the council that a Nuisance noise meeting has been requested with planning specialist.
a) EC/094/00401/23 - Kirkby Lane illegal small holding progress – Cllr Kemp told all that this application has been investigated and the land can be used for agricultural use which is what the landowner is claiming and that the on site caravan is being used for the storage of good and shelter/ welfare when they are on site. Without further evidence this will be concluded.
It was:-
Proposed by Cllr Briscombe and Seconded Cllr Armitage and RESOLVED that the council suspend standing orders to allow members of public to speak.
A member of public old the council that he has evidence to contradict what Cllr Kemp stated.
Another member of public told all that is has to be 5 hectares to constitute agricultural land and that is only just over one acre.
Another member of public claimed that this site is effectively a pig farm and should not be in the village as planning has been refused before for one that was further away due to its proximity to the area.
13. Finances:
a) Bank Balance and signing of Statements – December to date - £8443.79.
b) Payments required: -
i. M. Briscombe – Tree lights - £32.97
ii. A. Jackson – grass cutting churchyard - £60.00 (27.10.2025)
iii. Lloyds banking fee, Oct, Nov and Dec - £12.75
iv. M. Briscombe – Flag replacement - £80.00
v. S. Kulwicki – Wages for Nov and Dec - £444.40
vi. HMRC PAYE- £261.60
It was:-
Proposed by Cllr M. Obermuller and Seconded by Cllr C. Cole and RESOLVED by all for the above payments to be approved and duly paid.
c) Order has been placed for £37743.56 to KOMPAN for play equipment – see item 11.
14. Clerks’ report and correspondence
a) Response received from objection to how ELDC handled the application for Application 00385/25/FUL, dwelling ,garage and store on land West of Amberwood, LN106YT. The clerk suggested clarifying that this letter was from the parish council not just a member of public.
b) Pump has been purchased for the Ebrington Arms:
The STP objective is now successfully met (pub pump installed & commissioned).
The donations are collected and spent. As of today, in summary as follows:
* £8573 as total raised (after fees & one refund)
* £1000 to charity (surplus cash)
* £7214 mostly spent/needed for the project
* £359 remaining on hand for repairs etc
The project is now closed.
c) Precept forms to be submitted – Band D equation - £54.35
d) Better start Lincolnshire inclusion service – Consultation Live – The clerk asked all Cllrs to do this if they can.
15. The next meeting is scheduled for: 05th March 2026 at 7pm in Kirkby On Bain school hall. Are there any items for inclusion on the next agenda…
